Assault Attorney in Draper

Defense Counsel Who Knows How Utah Prosecutors Build Assault Cases

When you’re facing an assault charge in Draper, the attorney you choose matters more than most people realize. At Askar Law PLLC, our founder J.G. Askar spent a decade inside Utah’s criminal justice system as both a prosecutor and a public defender. That background means he understands how the other side constructs its case and where defenses can be most effective.

An assault charge can affect your job, your professional license, your housing, and your relationships long before a verdict is reached. Early intervention matters. We’re prepared to step in from the first hearing in Salt Lake County court through final resolution. Attorney Askar gives clients his personal cell phone number for direct text communication throughout the process, and we serve Spanish-speaking clients as well.

Don’t face this alone. We offer free consultations. Call (801) 761-4671 or reach out online to discuss your options with a Draper assault defense attorney today.

Understanding Utah’s Assault Statute

Utah’s assault statute combines what some states distinguish as assault and battery into a single offense. The legal term “assault” covers both the attempt to injure and the completed act that causes harm.

Under Utah Code § 76-5-102, an actor commits assault if they:

  • Attempt, with unlawful force or violence, to inflict bodily injury on an individual.
  • Commit an act, with unlawful force or violence, that causes bodily injury to an individual or creates a substantial risk of bodily injury to an individual.

To convict, the prosecution must prove beyond a reasonable doubt that your conduct was either an attempt to injure someone or an act that caused injury or created a substantial risk of injury. That case typically rests on victim testimony, witness accounts, and forensic or physical evidence. As your assault lawyers in Draper, we scrutinize how that evidence was gathered and analyzed at every turn, including how witnesses were identified and interviewed and whether law enforcement followed proper constitutional procedures.

Assault Charge Classifications & Penalties in Utah

Assault is a serious criminal offense in Utah. While simple assault is a misdemeanor, the charge can be elevated to a felony under specific circumstances, and the penalties increase significantly with severity.

  • Simple Assault (Class B Misdemeanor): The least severe charge. A conviction can result in up to six months in jail, a fine of up to $1,000, and a period of probation.
  • Class A Misdemeanor: The charge is elevated if the victim suffers substantial bodily injury or is pregnant and the defendant knew of the pregnancy. A conviction carries up to 364 days in jail and a fine of up to $2,500.
  • Aggravated Assault (Utah Code § 76-5-103): Assault becomes “aggravated” when it involves a dangerous weapon or other means likely to produce death or serious bodily injury. This is a third-degree felony, punishable by up to five years in prison. The charge rises to a second-degree felony, carrying up to 15 years in prison, if the assault results in serious bodily injury or if a strangulation or chokehold produces a loss of consciousness.

Assault charges can also be filed alongside domestic violence, reckless endangerment, or kidnapping charges, compounding the potential penalties significantly. We work to prevent charge enhancements and pursue a resolution that can minimize the impact on your life.

Additional Sentencing Consequences

  • Probation: A conviction may be followed by supervised probation with strict conditions. A violation can result in re-incarceration.
  • Mandatory Counseling: Courts may order participation in programs such as anger management as a condition of sentencing.
  • Restitution: You may be ordered to pay the victim for financial losses such as medical bills.

Building a Strategic Defense Against Assault Charges

Every case is unique, and we build a defense strategy tailored to your specific circumstances. Depending on the facts, your defense may include:

  • Self-Defense or Defense of Others: Utah law recognizes the right to use reasonable force in self-defense. We examine the full context of the confrontation to establish that your actions were a reasonable response to a genuine threat.
  • Lack of Intent (Mens Rea): Assault requires a specific mental state. If the act was accidental or a misunderstanding rather than an intentional use of unlawful force, it may not meet the legal definition of the charged offense.
  • Insufficient Evidence: The prosecution must prove guilt beyond a reasonable doubt. Inconsistent witness testimony, flawed forensic evidence, or gaps in the chain of custody can each undermine the state’s case.
  • Mistaken Identity: When identification rests on a single fleeting observation or a flawed lineup procedure, this defense can be particularly strong.
  • Constitutional Violations: An unlawful search and seizure or a coerced confession can lead to suppression of critical evidence before trial.

Why Draper Clients Choose Askar Law PLLC for Assault Defense

Our firm was founded by Attorney J.G. Askar, who brings ten years of experience on both sides of Utah’s criminal justice system, as a public defender and as a prosecutor. That dual background gives him direct knowledge of the evidence standards and argument patterns prosecutors use to elevate charges from misdemeanor to felony. Judges and other attorneys throughout the Utah system know our attorneys can be formidable adversaries in the courtroom because of those former roles.

We’ve handled hundreds of criminal cases, including over 30 felony jury trials. For professionals in the Draper area, where an assault charge can threaten a license, a security clearance, or a position in the tech or healthcare sectors, we factor those career stakes into the defense strategy from day one. Transparent flat-fee options for many cases mean you can budget clearly without worrying about unpredictable hourly billing, and Attorney Askar provides his personal cell phone number so you can reach him directly by text at any point.

Here’s what working with our team looks like in practice:

  • Personalized strategy: Every client gets a tailored approach, whether this is a first allegation or there are prior charges in your background.
